Proprietary 8-23 25 Deductible Waiver If you have been continuously insured under the Farmers-sponsored group E&O program for the past five policy periods and have not reported any claim(s) during that time, the deductible will be waived for the first reported claim involving Farmers business, provided certain conditions were met at the time that the business was written. Deductible Buy-Back For an extra $25 per month, you can eliminate the out- of-pocket expenses associated with your deductible (for both Farmers and non-Farmers business). The deductible buy-back eliminates a maximum of $10,000 each policy period for your agency should an E&O claim (or multiple E&O claims) be brought against you. It is important to note that you must have elected this optional endorsement prior to the date that you were made aware of the claim. See the policy for details. n Web Media Content Liability Coverage — This includes coverage for acts arising out of Social Media Activities; defamation, libel, slander, trade libel (related to disparagement or harm to reputation or character); invasion or interference with an individual’s right of publicity, including commercial appropriation of name, persona, voice, or likeness; infringement of copyright, trademark, trade name, trade dress, logo, title, metatag, or slogan, service mark, or service name. See the policy for details. n Broad Insolvency Carveback — This provides coverage for companies rated B+ or better (P&C) and A- or better (Life and A&H) by A.M. Best. Retroactive Date The retroactive date is the later of: n The date of inception of the agent’s or DM’s contract with Farmers Insurance Exchange; or n The date of the first continuously maintained claims made errors and omissions liability coverage without interruption. Note: If the insured agent is a party to a Retail or Agency Acquisition appointment agreement, the agent can apply for Extended Prior Acts coverage within 60 days of their full-time appointment.
